Why these shares

  • Husband: 1/4 when the deceased left children or son’s children, otherwise 1/2.
  • Mother: 1/6 with children or two or more siblings, otherwise 1/3 — here one-third of what remains after the spouse (ʿUmariyyah).
  • Father: 1/6 with a son; 1/6 plus the remainder with only daughters; the whole remainder with no children.
  • ʿUmariyyah case: the mother receives one-third of what remains after the spouse’s share.

Yes. Pakistani courts apply Islamic inheritance law to Muslims, following the Hanafi school for Sunni Muslims, together with the Muslim Family Laws Ordinance 1961 for grandchildren whose parent died first. Shia families follow Ja’fari rules, which differ.

Funeral expenses, debts (including any unpaid mahr) and any valid will (wasiyyat) of up to one-third to non-heirs. The shares apply to what remains.
